Terms and Conditions

These Terms and Conditions govern access to and use of the Horizon Watch Enterprise Inc. website, any related mobile experience, direct sales communications, invoices, payment links, and any purchase of products from Horizon Watch Enterprise Inc. By using the website, requesting information, placing an order, submitting payment, or accepting delivery of a product, the customer agrees to these Terms and Conditions, the separate Horizon Watch Enterprise Inc. Return Policy, and any additional written terms provided for a specific transaction.

1. Seller Identity and Independence

Horizon Watch Enterprise Inc. is the seller of record for all items offered through its website and direct customer channels. All products are sold directly by Horizon Watch Enterprise Inc. and not by any manufacturer, brand owner, marketplace, or upstream supplier unless expressly stated otherwise in writing. Horizon Watch Enterprise Inc. is an independent reseller of pre-owned luxury watches and is not an authorized dealer, distributor, service center, representative, sponsor, or agent of Rolex, Cartier, Patek Philippe, Audemars Piguet, Breitling, Omega, or any other watch brand. No affiliation, endorsement, sponsorship, or authorization by any brand is stated or implied unless expressly identified in writing for a specific product. Any reference to a brand name is used solely to identify the branded product offered for resale.

2. Eligibility and Acceptable Use

By using this website or purchasing from Horizon Watch Enterprise Inc., the customer represents that the customer is at least 18 years old and has the legal capacity to enter into a binding contract. The customer agrees to use the website only for lawful purposes and not for fraud, abuse, unauthorized access, speculative purchasing, payment manipulation, export evasion, sanctions evasion, or any conduct that interferes with the website, any transaction, or any other user. Horizon Watch Enterprise Inc. may refuse service, restrict access, cancel orders, or limit quantities where fraud, suspicious activity, identity concerns, sanctions concerns, pricing error, inventory error, chargeback risk, or policy abuse is suspected or identified.

3. Product Descriptions and Condition

Unless expressly stated otherwise, all watches sold by Horizon Watch Enterprise Inc. are pre-owned goods and may show ordinary signs of prior ownership, age, service, polishing, handling, wear, replacement parts consistent with the age or service history of the watch, or other characteristics disclosed in the listing or visible in photographs. Product images and descriptions are intended to identify the specific item offered, but minor visual differences may appear due to lighting, magnification, reflection, or display settings. Customers are responsible for reviewing all listing details before purchase, including model, reference number, condition notes, dimensions, included accessories, and all seller disclosures. Questions about originality, condition, timing performance, bracelet sizing, service history, or included contents must be asked and answered before payment is submitted.

4. Pricing, Availability, and Order Acceptance

All prices are listed in U.S. dollars unless otherwise stated. Availability is not guaranteed until Horizon Watch Enterprise Inc. accepts the order and confirms full cleared payment, because pre-owned watches are unique or limited-inventory items and may be offered through more than one sales channel simultaneously. Horizon Watch Enterprise Inc. reserves the right to correct typographical, clerical, pricing, tax, inventory, or listing errors before shipment. If a material error is discovered before shipment, Horizon Watch Enterprise Inc. may cancel the order and refund amounts actually received. A cart submission, checkout, invoice request, deposit, or payment authorization is an offer to purchase and does not become binding on Horizon Watch Enterprise Inc. until Horizon Watch Enterprise Inc. accepts the transaction in writing or ships the item. Horizon Watch Enterprise Inc. may require identity verification, payment confirmation, wire confirmation, or additional customer information before accepting or shipping any order. If Horizon Watch Enterprise Inc. is unable to verify payment, customer identity, shipping risk, or order legitimacy, Horizon Watch Enterprise Inc. may cancel the order and refund amounts actually received, less any nonrefundable third-party charges to the extent permitted by law and disclosed to the customer.

5. Payment

Accepted payment methods may include bank wire, credit card, debit card, financing, or other methods approved by Horizon Watch Enterprise Inc. Orders are not complete until payment has been received, cleared, and approved by Horizon Watch Enterprise Inc. and any applicable payment provider or financial institution. Title to the watch will not pass to the customer until Horizon Watch Enterprise Inc. has received cleared payment in full. Horizon Watch Enterprise Inc. may delay shipment, hold funds, reject payment, or request additional verification where a transaction is flagged for fraud review, address mismatch, chargeback history, unusual pattern, or other payment risk. The customer is responsible for any applicable sales tax, use tax, customs duty, import duty, brokerage fee, VAT, or other governmental charge associated with the transaction unless Horizon Watch Enterprise Inc. is legally required to collect and remit such amounts.

6. Shipping and Delivery

Horizon Watch Enterprise Inc. ships only after payment has cleared and any required verification has been completed. Delivery estimates are not guarantees because carrier delays, weather events, security reviews, customs processing, or other events outside Horizon Watch Enterprise Inc.'s reasonable control may affect transit times. Horizon Watch Enterprise Inc. may require adult signature, delivery hold, secure-location pickup, shipment to a verified address, or other protective shipping conditions. Horizon Watch Enterprise Inc. may decline shipment to P.O. boxes, freight forwarders, hotels, temporary addresses, or any destination deemed high risk. If Horizon Watch Enterprise Inc. permits or requires a customer-provided shipping label, pickup arrangement, or customer-selected courier, the customer is solely responsible for providing complete and accurate shipping information, insurance instructions, and delivery directions. Horizon Watch Enterprise Inc. is not responsible for delay, misdirection, or non-delivery caused by inaccurate customer instructions or customer-selected transportation arrangements. If the customer arranges pickup or customer-controlled shipping, risk of loss transfers to the customer upon handoff to the customer or the customer's designated carrier or agent.

7. Inspection Upon Delivery

The customer must inspect the package and product promptly upon delivery. Any claim involving shipping damage, missing contents, tampering, or incorrect item must be reported to Horizon Watch Enterprise Inc. in writing immediately and in all cases no later than 24 hours after confirmed delivery, with photographs of the packaging, label, and item condition where applicable. Prompt notice is required because delays can impair shipping-insurance and carrier-claim rights in high-value transactions. This requirement does not waive any non-waivable legal rights under applicable law.

8. Returns and Refunds

All returns, return eligibility, return timing, shipping responsibilities, refund conditions, and final-sale exclusions are governed exclusively by the separate Horizon Watch Enterprise Inc. Return Policy in effect on the date of purchase. Certain products or transactions may be designated as final sale and are not eligible for return, including special orders, sourced-on-request watches, customized items, altered or resized items, discounted liquidation items, and any listing or invoice expressly marked as final sale before payment.

9. Authenticity and Warranties

Horizon Watch Enterprise Inc. represents that each watch sold is believed to be authentic based on its sourcing and review process. If a customer raises an authenticity concern, the customer must notify Horizon Watch Enterprise Inc. promptly in writing, preserve the item in the condition received, and allow Horizon Watch Enterprise Inc. a reasonable opportunity to inspect the watch before any refund, reversal, or public statement is made. Horizon Watch Enterprise Inc. may require third-party inspection by a mutually acceptable professional before resolving an authenticity dispute. Manufacturer warranty coverage, manufacturer service history, original accessories, and factory water-resistance certification may not be included unless expressly stated in writing for a specific watch. If Horizon Watch Enterprise Inc. provides a written limited warranty for a specific watch, that warranty will be described separately in the listing, invoice, or accompanying warranty document and is separate from any manufacturer warranty. Except for any express written warranty from Horizon Watch Enterprise Inc. and except to the extent prohibited by law, products are sold as-is, as available, and with all faults consistent with a pre-owned luxury good. To the fullest extent permitted by law, Horizon Watch Enterprise Inc. disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Fraud Prevention and Customer Representations

By purchasing from Horizon Watch Enterprise Inc., the customer represents that the customer is the authorized user of the payment method used and is not engaged in fraud, money laundering, export evasion, item switching, false chargebacks, or any other unlawful conduct. Horizon Watch Enterprise Inc. may record serial numbers, movement identifiers where available, bracelet details, accessories, package contents, and shipment evidence for fraud prevention, dispute handling, insurer support, and law-enforcement cooperation. Customers agree to contact Horizon Watch Enterprise Inc. first to seek good-faith resolution before initiating a chargeback or payment dispute. False, abusive, or avoidable chargebacks may be treated as breach of these Terms and Conditions and may result in denial of future service, submission of records to the payment processor, and pursuit of lawful recovery remedies. Where a customer obtains a chargeback or payment reversal after Horizon Watch Enterprise Inc. has shipped or delivered the watch, Horizon Watch Enterprise Inc. reserves all rights to recover the watch, the purchase price, shipping costs, investigation costs, and any related damages allowed by law.

11. Intellectual Property

All website content, including text, graphics, layout, product photography, descriptions, logos, trade dress, software, and design elements created by or for Horizon Watch Enterprise Inc., is owned by Horizon Watch Enterprise Inc. or its licensors and may not be copied, reproduced, scraped, republished, distributed, or used without prior written permission. The customer receives only a limited, revocable, non-exclusive right to access the website for personal, non-commercial shopping purposes consistent with these Terms and Conditions. Automated scraping, bots, data extraction, reverse engineering, or competitive reuse of website content is prohibited.

12. Electronic Communications

The customer agrees that Horizon Watch Enterprise Inc. may communicate by email, phone, text message, or other reasonable electronic means regarding orders, support, returns, verification, security, and marketing subject to applicable law. Electronic signatures, records, checkboxes, email confirmations, and digital invoices will have the same legal effect as paper records to the extent permitted by law.

13. Third-Party Services

The website may use or link to third-party services including financing providers, payment processors, shipping carriers, insurance providers, analytics tools, and other platforms. Horizon Watch Enterprise Inc. is not responsible for the acts, omissions, content, policies, or terms of those third parties, and the customer's relationship with each third party is governed by the applicable third-party terms.

14. Limitation of Liability

To the fullest extent permitted by law, Horizon Watch Enterprise Inc. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, loss of use, loss of opportunity, reputational harm, or data loss arising out of the website, a purchase, a return, a payment dispute, or these Terms and Conditions, even if advised of the possibility of such damages. To the fullest extent permitted by law, Horizon Watch Enterprise Inc.'s aggregate liability for any claim relating to a product or transaction will not exceed the amount actually paid by the customer to Horizon Watch Enterprise Inc. for the specific product giving rise to the claim. Some jurisdictions do not permit certain liability limitations, so this provision applies only to the extent allowed by applicable law.

15. Indemnification

The customer agrees to defend, indemnify, and hold harmless Horizon Watch Enterprise Inc., its officers, directors, employees, contractors, affiliates, successors, and agents from and against all claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees where permitted by law, arising out of the customer's fraud, misuse of the website, breach of these Terms and Conditions, violation of law, export violation, payment abuse, or infringement of any third-party rights.

16. Governing Law and Dispute Resolution

These Terms and Conditions and any dispute between the customer and Horizon Watch Enterprise Inc. will be governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except where federal law applies or non-waivable consumer protection law requires otherwise. Before filing arbitration or litigation, the parties will attempt in good faith to resolve the dispute informally for at least 30 calendar days after written notice from the party asserting the dispute. If informal resolution fails, Horizon Watch Enterprise Inc. may require that the dispute be resolved by binding individual arbitration in Miami-Dade County, Florida, before a single arbitrator under the applicable rules of the American Arbitration Association, except that either party may bring an eligible claim in small claims court and Horizon Watch Enterprise Inc. may seek temporary or injunctive relief in court to address fraud, chargeback abuse, intellectual property misuse, confidentiality breach, or unlawful possession of property. To the fullest extent permitted by law, disputes must be brought only on an individual basis and not as a plaintiff or class member in any class, consolidated, collective, or representative action.

17. Force Majeure

Horizon Watch Enterprise Inc. will not be responsible for delay or failure to perform caused by events outside its reasonable control, including weather events, natural disasters, carrier interruption, cyberattack, payment network outage, supplier delay, customs hold, labor disruption, governmental action, pandemic-related disruption, civil unrest, terrorism, or other force majeure circumstances.

18. General Provisions

If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law. Failure by Horizon Watch Enterprise Inc. to enforce any right or provision on one occasion will not constitute a waiver of that right or provision. The customer may not assign any rights or obligations under these Terms and Conditions without Horizon Watch Enterprise Inc.'s prior written consent. Horizon Watch Enterprise Inc. may assign its rights and obligations to an affiliate, successor, purchaser, financing party, or service provider in connection with a merger, asset sale, financing, or business reorganization. These Terms and Conditions, together with the separate Return Policy, any applicable invoice, listing terms, warranty document, privacy disclosures, financing terms, and order-specific written terms, constitute the entire agreement between Horizon Watch Enterprise Inc. and the customer with respect to the transaction.
